What is the process for the Reinstatement of Parental Rights (RPR) Cause Code in Juvenile Dependency Case Type 7 in SCOMIS?
Step 1: Initiate the case in JIS. Refer to the step-by-step instructions for filing a dependency case as outlined in JIS Case Processing (Superior Courts) for Non-Criminal Cases.
Step 2: Update the family relationship of the participants in the Relationship field if necessary. The child petitioning the court for reinstatement of parental rights is reflected as TRC (Terminated Child Relationship). The parent(s) whose parental rights the child wants reinstated is/are reflected as TRP (Terminated Parent Relationship).
Step 3: Verify the case in SCOMIS.
Step 4: Docket the threshold hearing date and time.
Step 5: Record the outcome of the threshold hearing in SCOMIS.
- If the court dismisses the petition for reinstatement, the case should be resolved and completed. Refer to the Resolve and Complete section of the SCOMIS Manual.
- If the petition is not dismissed, docket the date and time of the hearing on the merits.
Step 6: Record the outcome of the hearing on the merits:
- If the court dismisses the petition for reinstatement, the case should be resolved and completed. Refer to the Resolve and Complete section of the SCOMIS Manual.
- If the petition is not dismissed, docket the review hearing as the petition for reinstatement of parental rights is conditionally granted and a parent's rights are conditionally reinstated pending the outcome of the six-month review. The case should be resolved, but not completed. Refer to the Resolve and Complete section of the SCOMIS Manual.
Step 7: Record the outcome of the review hearing:
- If the court dismisses the petition for reinstatement, the case should be completed.
- If the petition is granted, record the completion of the case once the Order Reinstating Parenting Rights (ORRPR) has been entered. Refer to the Resolve and Complete section of the SCOMIS Manual.
- Update the relationships in JIS on the Family Relationship Case (FRC) screen to reflect PAR (Parent) and CHD (Child). Refer to the Relationships for Case Participants section of the JIS Online Manual.
Step 8: In the event the court dismisses the petition any time prior to the six-month review hearing based upon new abuse/neglect, the previously entered resolution should be changed and then the case should be completed.
